Uncontested Divorce

An uncontested divorce is one in which both spouses have reached an agreement on the terms of the divorce, such as, grounds for divorce, child support, custody, parenting visitation schedule, maintenance (spousal support or alimony), division of marital assets, property and debt.  An uncontested divorce is often a cheaper and quicker alternative to a contested divorce that may lead to long, costly, and emotionally draining court battles.  

 

An uncontested divorce may also be obtained if your soon-to-be ex-spouse defaults.  When a divorce action is commenced, you must serve the Summons with Notice or Summons and Complaint within 120 days of filing said documents with the Court.  If your spouse fails to appear or answer within 40 days of being served, then he/she would be in default.  Once your spouse is in default, you may proceed to obtain an uncontested divorce.
